Terms of Service
These terms govern your use of the Flare iOS app and this website, operated by SoinsAI LLC ("we", "us"). By using Flare, you agree to them.
1. License
Your license to use the Flare app is governed by Apple's standard Licensed Application End User License Agreement (EULA). These terms supplement that EULA; if they conflict, the EULA controls for matters it covers. The app is licensed to you, not sold, for personal, non-commercial use on Apple devices you own or control.
2. Subscriptions
Some features (weather trigger alerts, full trigger analysis, prep plans, and doctor reports) require a paid subscription, Flare Pro, available monthly or yearly.
- Payment is charged to your Apple Account at confirmation of purchase. Prices are shown in the app before you buy.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Manage or cancel anytime in your Apple Account settings (Settings > your name > Subscriptions). Deleting the app does not cancel a subscription.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Refunds are handled by Apple under Apple's policies.
3. Alerts and forecasts
Flare's alerts and risk forecasts are predictions based on public weather data and, where available, your own logged patterns. Weather forecasts can be wrong, alerts can be delayed by factors outside our control (including your device settings and network conditions), and correlations are observations, not medical conclusions. Do not rely on Flare as your only way of preparing for symptoms.
4. Your data
How we handle data is described in our Privacy Policy. In short: your health data stays on your device; our servers process only what is needed to deliver weather alerts.
5. Acceptable use
You agree not to misuse Flare or its services, including attempting to access our servers beyond their intended use, interfering with the service, reverse engineering the app except where the law permits, or using the service to violate any law.
6. Intellectual property
Flare, the Ember mascot, and all app and website content are owned by SoinsAI LLC and protected by law. You may not copy, modify, or distribute them without our permission, except as allowed by the EULA.
7. Disclaimer of warranties
Flare is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability, to the maximum extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, SoinsAI LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use Flare, including reliance on any forecast or alert. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim, or fifty US dollars, whichever is greater. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Termination
You can stop using Flare at any time by deleting the app. We may suspend or end access to server-side features for misuse of the service. Sections 6 through 8 survive termination.
10. Changes
We may update these terms as Flare evolves. The date above reflects the latest version. Continued use after changes means you accept them. Meaningful changes will be noted in the app's release notes.
11. Governing law
These terms are governed by the laws of the United States and of the state in which SoinsAI LLC is organized, without regard to conflict of law rules.
